Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Write Digital Marketing (“we,” “us,” or “our”) governing your use of Clankers, our AI texting assistant service at writedigitalmarketing.com. By creating an account or texting your assistant, you agree to these Terms.

The Service

The service lets you create a personal AI assistant that is assigned a dedicated SMS/MMS phone number. You save that number as a contact and text it directly, or add it to an existing group thread. In group threads, the assistant replies only when it is addressed by name. The assistant never initiates contact and never sends marketing messages. Replies are generated by artificial intelligence.

Eligibility

The service is available to residents of the United States who are at least 18 years old. By using the service, you represent that you meet these requirements and that any phone number you use with the service is your own or one you are authorized to use.

Messaging Terms

The assistant is a consumer-initiated, two-way conversational messaging program. You opt in by sending the first message to your assistant’s dedicated number, either directly or by addressing it by name in a group thread a subscriber added it to. Any inbound message constitutes opt-in. The assistant only sends messages in reply to messages it receives. For example, the assistant’s first reply looks like this (where “Ava” is the name you chose for your assistant):

Clankers: Hi, I’m Ava, your AI assistant. Text me questions here, or mention my name in a group thread. Msg frequency varies. Msg&data rates may apply. Reply HELP for help, STOP to opt out.

Reply STOP to opt out at any time. STOP halts all messages from the service to your phone number, including messages in any group threads the assistant is part of.
Carriers are not liable for delayed or undelivered messages.

Acceptable Use

You agree not to:

Use the service for any unlawful purpose or in violation of any applicable law or regulation.
Use the assistant to send spam, marketing, or promotional messages, or any unsolicited messages to others.
Use the service to harass, threaten, or defraud any person.
Add the assistant to group threads whose participants have not agreed to its presence.
Attempt to circumvent opt-outs, rate limits, or other technical protections of the service.
Resell or provide the service to third parties without our written permission.

We may suspend or terminate accounts that violate these Terms.

Subscription and Billing

The service is offered through paid subscription plans, billed in advance on a recurring basis. Current plans and prices are listed on our pricing page. You can manage your plan, update payment details, or cancel at any time through the billing portal in your account. Cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.

AI-Generated Content

The assistant’s replies are generated by artificial intelligence and may be inaccurate, incomplete, or outdated. They are provided for informational purposes only and are not professional, legal, medical, or financial advice. You are responsible for evaluating any reply before relying on it.

Disclaimers and Limitation of Liability

The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, timely, or error-free, or that messages will be delivered.

To the maximum extent permitted by law, Write Digital Marketing will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us for the service in the twelve months before the claim arose.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and post the new version on this page. Continuing to use the service after changes take effect means you accept the updated Terms.
